Terms and Condition

1. 1. The below Terms & Conditions are a legal binding agreement between you as the client and NannyPro as the agency.
   2. Completion of the following – registering on NannyPro’s website, completion of the Care Request Form – is mutually acceptance of the agency Terms & Conditions.
   3. The word “Client” refers to the person/family using NannyPro’s services.
   4. The word “Nanny/Babysitter” refers to any NannyPro offers the client access to the services and use of the NannyPro website and agency. By registering with NannyPro, the client agrees to abide by these Terms & Conditions. If the client does not agree to abide by these Terms & Conditions, then the client must refrain from using the NannyPro website.
   5. Posting false, incomplete, inaccurate or illegal information is strictly prohibited by law.

2. Client Obligations

1. 1. Any correspondence, communication either verbally, written or via email is confidential and the client agrees not to disclose to third parties.
   2. All nanny /babysitting bookings must be made directly between you (the client) and NannyPro (the agency).
   3. No bookings are to be made directly with the nanny / babysitter. Should this obligation be ignored the nanny / babysitter is legally obliged to inform the agency and the relevant fees will be charged to the client.
   4. The client agrees there is a minimum 4 hour booking fee payable to the babysitter.
   5. The client agrees that NannyPro requires our nannies / to work and be in a safe, warm and friendly environment.
   6. Where NannyPro (in its absolute discretion) believes that there is sufficient negative feedback or feedback is of a concerning nature regarding the client, then NannyPro will refrain from referring any nannies or babysitters.
   7. The client agrees to pay nannies / babysitters transport fee if NannyPro deemed necessary, if applicable.
   8. Once the client offers employment to one of NannyPro’s nannies – the client understands NannyPro will raise an invoice in advance, a trial fee or full payment is required to confirm the service.
   9. Client agrees to enter into an employment contract with the Nanny and abide by all statutory obligations of employment regulated by the law of Singapore.

3. Fees Payment

1. 1. Fees are payable in Singapore Dollars.
   2. An invoice will be provided by NannyPro to the client when the client confirms the babysitter/nanny after confirmation of services via written communicatio eg email, or whatsapp. The invoice must be settled accordingly to the due date as stated on the invoice.
   3. If the client is not satisfied with the nanny/ babysitter/ after the trial period, the trial fee of the nanny is still applicable. NannyPro will pay the nanny / babysitter accordingly to the ad-hoc rates. NannyPro is able to seek an alternative nanny/babysitter, an additional trial fee applies.
   4. Client agrees to inform NannyPro if a nanny/babysitter requires additional days or extended hours from initial request.
   5. NannyPro reserves the right to increase our agency fees at any time.

4. Cancellation Policy and No-Refund Policy

1. 1. If cancellation of the nanny/babysitter is made by the client within 24 hours of the start-time, the trial fee or deposit will be forfeited.
   2. NannyPro will ensure that nanny/babysitter will stay committed, however cannot be held responsible for cancellations or no-shows of a nanny/babysitter. In the event such an incident happens, NannyPro will refund the trial fee or seek a replacement nanny to attend to the care request.
   3. If the client cancels the care service or terminate the employment arrangement thus breaking the contract, an agreement for the payment must be made between the client and NannyPro. If the notice period is being served, the one-time Engagement Fees will not be refunded. The following will be the resolution for the issue:
      1. (i.) For ad-hoc care, the client MUST pay the nanny/babysitter following the ad-hoc rates for ad-hoc care service.
      2. (ii.) For Full-Time Monthly Rates, NannyPro will pay the pro-rated monthly full-time rate according to the service already provided by the nanny and refund the balance of the fee to the client accordingly.
   4. If the nanny/ babysitter/ cancels employment thus breaking the contract within the guaranteed period of 1 month, NannyPro will seek alternative nanny/babysitter for the client and the one-time engagement fee will then be waived on the next nanny/babysitter. The following will be the resolution for this issue:

5. Liability

1. 1. By using NannyPro, the client expressly authorises NannyPro to collect and publish information about them as detailed in these terms and conditions and the client expressly waives any rights, whether in statute or at common law, to bring any legal action against NannyPro as a result of NannyPro’s publication of such information, whether the client considers that information to be fair and accurate or not.
   2. NannyPro endeavours to validate the background of our nannies/babysitters. We cannot guarantee that all the information is correct. NannyPro conducts thorough checks and conducts interviews. In the event of any mishap (not limited to a small cut due to falling down and a major car accident) happening to the client’s child/children when the nannies/babysitters are handling them, NannyPro WILL NOT be liable for any of the mishap costs or responsibility and the client will totally EXCLUDE NannyPro in the event of any mishap.
   3. NannyPro website does contain links to third party advertisements and links to third party sites. Access to any other Internet site linked to NannyPro website, is at the clients own risk. NannyPro accepts no responsibility for the accuracy or reliability of any information, opinions, or statements made in any third party advertisements or on any third party sites.
   4. Any outside users from other countries can access this website – NannyPro makes no representation, the client expressly waive any rights whether in statute or at common law, to bring any legal action against NannyPro as a result of NannyPro’s publication of content within this website. The clients are responsible for ensuring compliance with all laws where they are located.

6. Confidentiality

1. 1. All communication between both parties (NannyPro & Clients) shall remain confidential.
   2. NannyPro requires the client to provide accurate details of their address, contact details and full name.
   3. NannyPro will release other personal information only when the above release is appropriate for the function of the website, to comply with the law; enforcement of our terms and conditions; or protect the rights, property, or safety of NannyPro, our users or others. However you authorise your babysitter to tell a family member or friend where she/he will be, the expected return time and address of the babysitting booking. This is a simple safety measure for the babysitter.

7. Warranties and Indemnities

1. 1. No warranty is given for suitability honesty and capability, character of any candidates.
   2. NannyPro make no warranties or representations as to the quality, accuracy or completeness of the content on the site or the information otherwise provided by any member.
   3. The Client will hold NannyPro harmless against any claims arising out of any claims brought against it arising from the Client’s dealings with and treatment of the nanny or babysitter howsoever arising.
   4. While NannyPro uses reasonable endeavours to ensure that the site is available 24 hours a day, NannyPro does not make any representations or warranties that your access will be uninterrupted or error free. Access to the site may be suspended temporarily without notice in the case of system failure, webhosting errors, maintenance or repair or any reason beyond our control.

8. Disputes

1. 1. NannyPro prefers to resolve any disputes via mediation. However if the dispute escalates, other forms of mediation not limited to the Singapore Police Force and Ministry of Law may be involved to resolve the matter.

9. Governing Law

1. 1. The Terms and Conditions shall be governed in accordance with the laws of Singapore.
   2. If any provision of this Agreement is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction, such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if this Agreement had been agreed with the invalid illegal or unenforceable provision eliminated.
